These Terms of Service ("Terms") are an agreement between you and jUSt Livin Custom Wood Works ("BUILD IT," "we," "us"), the operator of custombuildit.com (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What BUILD IT is — and is not
BUILD IT turns a written description of a project into an estimate: a materials list, a cost estimate, and, on paid plans, a cut list, build sequence, and dimensioned drawings. The output is generated by software, including artificial-intelligence models, from the information you provide.
BUILD IT is an estimating and planning aid. It is not engineering, architectural, or contracting advice, and it is not a substitute for a licensed professional. In particular:
- Nothing the Service produces is a stamped, sealed, or certified design.
- Structural loads, elevated platforms, stairs, railings, decks, roofs, retaining walls, electrical, gas, plumbing, HVAC, fire safety, permits, and building-code compliance require review by an appropriately licensed professional and, where applicable, your local building authority.
- Every estimate includes assumptions the software had to make. You are responsible for reading them and confirming every dimension, quantity, and material before purchasing, cutting, or building.
- Prices shown are planning allowances, not quotes from any supplier.
You alone decide whether and how to build anything. You accept all risk arising from the use of any estimate, drawing, or instruction produced by the Service.
2. Your account
You must be at least 18 years old and able to form a binding contract. You are responsible for keeping your password confidential and for all activity under your account. Tell us promptly at support@custombuildit.com if you believe your account has been accessed without permission. One person per account; do not share credentials.
3. Plans, billing, and cancellation
Free plan. The free plan includes a limited number of projects per calendar month with a limited set of features, as described on the pricing page. We may change what the free plan includes at any time.
Paid plans. Paid plans are subscriptions billed in advance for each billing period (monthly or quarterly, as shown at checkout) and renew automatically until cancelled. The features and monthly project limits of each plan are described on the pricing page; unused projects do not roll over.
Payment processing. Payments are processed by Stripe, Inc. When you buy a plan, Stripe acts as the merchant of record: Stripe charges your payment method, calculates and collects any applicable sales tax or VAT, and issues receipts. Stripe's terms for purchases apply to the payment transaction. BUILD IT does not see or store your full card number.
Cancelling. You can cancel at any time from your dashboard ("Manage billing"). Cancelling stops future charges; you keep your plan's features until the end of the period you already paid for, then move to the free plan. Your saved projects stay in your account.
Refunds. See our Refund Policy, which is part of these Terms.
Price changes. We may change plan prices. A change applies to your subscription only at your next renewal after we give you at least 30 days' notice by email.
Failed payments. If a renewal payment fails, access to paid features is suspended until payment succeeds. Stripe will retry the payment and email you.
4. Fair use
Each plan's monthly project limit is the intended use. "Unlimited" plans are subject to a reasonable fair-use ceiling to prevent abuse; we will tell you if you reach it. You may not use automated tools to submit requests, resell access, or use the Service to build a competing product.
5. Your content and our output
What you give us. You keep ownership of the descriptions, photos, and other material you submit ("Input"). You grant us a license to use Input to operate the Service for you, including sending it to the AI providers described in our Privacy Policy. Do not submit content you don't have the right to share, or personal information about other people.
What we give you. Subject to these Terms, you may use the estimates, lists, drawings, and instructions the Service produces for you ("Output") for your own personal projects, and on plans that include a commercial-use license, for your business, including quoting and building for customers. Output generated by AI may be similar to output generated for other users; we do not guarantee it is unique.
6. Acceptable use
Do not use the Service to plan anything illegal, to design weapons or devices intended to injure, to circumvent safety codes, or to harass or defraud anyone. Do not probe, scrape, overload, or interfere with the Service. We may refuse to generate a design we consider unsafe.
7. Availability and changes
We work to keep the Service available but do not guarantee uninterrupted operation. We may change, suspend, or discontinue features. If we discontinue the Service entirely, we will give paying customers at least 30 days' notice and a way to export their projects.
8. Disclaimer of warranties
THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY ESTIMATE, QUANTITY, DIMENSION, DRAWING, OR INSTRUCTION IS CORRECT, COMPLETE, SAFE, OR COMPLIANT WITH ANY CODE OR LAW.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BUILD IT AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, MATERIALS, OR LABOR, OR FOR PROPERTY DAMAGE OR PERSONAL INJURY ARISING FROM THE USE OF ANY OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR $50 IF YOU PAID NOTHING.
Some jurisdictions do not allow certain limitations; in that case these limits apply to the extent permitted.
10. Indemnity
You agree to defend and hold harmless BUILD IT and its owner from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service or Output, your Input, or your violation of these Terms, including any claim by a customer of yours or anyone injured by something you built.
11. Termination
You may close your account at any time by emailing support@custombuildit.com. We may suspend or terminate accounts that violate these Terms. Sections 1, 5, 8, 9, 10, and 12 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. Before filing, you agree to contact us and try to resolve the issue informally for 30 days.
13. Changes to these Terms
We may update these Terms. For material changes we will email account holders or post a notice on the Service at least 14 days before they take effect. Continuing to use the Service after that means you accept the new Terms.
